1. Definitions
In these Conditions of Booking, “we”, “us” and “our” are
references to Caledonian Leisure Ltd t/a UKBreakaways and “you” and “your” are
references to the person booking with us..
2. The Contract
These conditions of booking and the booking confirmation will be
part of the contract under which UKBreakways acts as an agent for the
accommodation provider or as a tour operator if the break also includes
entrance tickets and/or transport. Under the contract we agree to provide the
supplies detailed on your booking confirmation. All payments made to us will be
protected in a gold-standard trust fund until your break is completed in
accordance with the UK package travel regulations.
3. Booking Confirmation
If you have booked on-line or have booked by telephone or
through an agent and have received a copy of our current brochure, the Contract
will come into effect as soon as you have booked. If you have booked by
telephone or through an agent and have not received a copy of our current
brochure you may notify us that you have changed your mind; within 5 days of
confirmation of your booking; or more than 7 days before the start of your
holiday – which ever is the sooner. In this instance we may refund your deposit
and any insurance premiums. Once the contract exists, your rights to cancel are
set out in clause 11.

For breaks that include a show, event or a sports ticket as part of the package, the deposit will vary.
The balance of your holiday cost is then payable six weeks prior
to arrival for most breaks and eight weeks prior to arrival on all breaks that
include a ticket to a show or event.
If you do not make your balance payment on time, we reserve the
right to cancel the break and keep the deposit. There will be no additional
charge made when booking using a credit or debit card although we do reserve
the right to pass on any supplementary charges by way of a nominal charge.
Booking confirmation will be sent to you in a digital format. Paper copies may
incur a small charge and will normally only be issued on request.
5. Advertised Facilities
Some of the facilities advertised by our suppliers (for instance
leisure facilities or WIFI) may attract a supplementary charge.
6. Inclusive Breaks
UK Licensing Legislation stipulates that alcoholic drinks
promotions may not be unlimited. Most inclusive breaks will include a maximum
number of alcoholic drinks available to each guest per day and may use a drinks
voucher or bar-credit system to comply with licensing laws.
7. Changes to your break
There may be circumstances in which we have to change the
details of your booking. In this unlikely event we will notify you of these
changes as soon as possible and the contract will continue in force. In the unusual
event that we have to make a significant change you may cancel you booking by
notifying us within 5 working days of receipt by you of our notification (or
within a shorter period of time if our notice to you so requires). If you
cancel your booking in accordance with this clause we will reimburse the
deposit and any other monies received from you in respect of the booking.
8. Price revision
‘Caledonian Leisure (trading as ukbreakaways.com) reserves the right to change advertised prices in any event. Advertised prices are correct at the time of publication or promotion, but may be subject to change at the company’s discretion.
Once you have booked with us, we may only change the price of your holiday in certain circumstances and under no circumstances will we change the price less than seven days before your holiday or break. More than seven days prior to your holiday or break we will only change the price of your booking to the extent of any increases in taxes, dues, fees, exchange rates or any changes to costs directly incurred by the company. Caledonian Leisure (trading as ukbreakaways.com) will always absorb the first 2% of any such cost increases. A price increase of more than 10% on your booking will automatically be considered a significant change and you may reserve the right to cancel your booking without penalty in accordance with clause 7.
9. If you wish to cancel your holiday
For all ukbreakaways breaks that do not include a ticket for a show or event.

Please note that the minimum cancellation charge is the amount
of the deposit plus any insurance.
10. Transferring your booking
If you are unable to go on the break due to unforeseen
circumstances you may transfer your booking to another person provided you
notify us as soon as possible and at least 7 days before arrival. We shall be
entitled to charge a £10 administrative charge and to charge you for any other
additional costs incurred by us as a result of the transfer of the booking. If
you wish to change any other details of your booking we will endeavour to meet
your requirements so far as possible. However, we reserve the right to charge a
£10 administration charge and to charge you for any other costs which we may
incur as a result of your change.
11. Circumstances beyond our control
We shall not be liable for any delivery limitations under this
contract in unforeseen circumstances where the limitations are beyond our
control. Examples of circumstances beyond our control are pandemics, force
majeure, government restrictions, industrial unrest and extreme weather.
12. Holiday insurance
We are able to offer a competitively priced, optional holiday
insurance policy. UKBreakaways cannot be held responsible for costs arising
from a failure to take out adequate holiday insurance cover.
13. Our liability and responsibility to you
We take every care to ensure that your break will be as enjoyable
and as safe as possible and in turn you agree to abide by any reasonable rules
& regulations in place with our suppliers. In the unusual event of any
problems with your booking please contact the provider of your accommodation
(or other services) as soon as possible. If they are unable to address the
problem please let us know immediately we will endeavour to resolve the issue.
Please note that except in cases of gross negligence the liability of our
suppliers and/or UKBreakaways shall be limited to the value of your booking.
14. Special Requests
If you have any special requirements - for instance low floor
bedrooms – you should notify these to us at the time of booking. Please check
these are detailed on your booking confirmation. We will do our best to provide
for your requirement, however, special requests cannot be guaranteed.

15. Protecting your money
All monies paid to us and/or our agents for your holiday are deposited in a secure independent Trust Account held with our partners Santander, under the management of PT Trustees and ABTOT (Associated Bonded Travel Operator Trust). This means that in the unlikely event that we become insolvent and have to cancel the holiday, you will be able to obtain a full refund. Caledonian Leisure Ltd also holds a comprehensive Tour Operator Liability insurance policy with Towergate Insurance Ltd, providing further protection for our holidaymakers.
